Judge of Sabail District Court of Baku, E. Shamayev his willful decision canceled effect of Article 119.3.1 of the CPC of the Republic of Azerbaijan, pointing in the decision that it is impossible to appeal to the court refusing to recognize the person as participant in the process.

Judges of Baku Appeal Court V. Mursakulov, P. Huseynov and G. Akhmedov supported the lawmaking process of Judge E. Shamayev.

The Supreme Court gave no clear answer on this appeal.
