Prosecutor General’s Office commented on the acquittal of a person convicted of premeditated murder

The Prosecutor General’s Office commented on the issue of acquitting a person convicted of premeditated murder. As reported by oxu.az with reference to the supervisory authority, some media reported information about the acquittal of Polad Ismayilov, who was found guilty under Article 120.1 (premeditated murder) of the Criminal Code of Azerbaijan, by the Sheki Court of Appeal.

It was noted that on February 24, 2011, the prosecutor’s office of the Zagatala district opened a criminal case on the discovery of the body of a resident of the Zagatala region, Seyran Eyyubova, with signs of violence, and based on the evidence obtained during the investigation of the criminal case, P. Ismayilov was charged under Article 120.1 of the Criminal Code Code of Azerbaijan, a preventive measure in the form of arrest was chosen against him.

“The criminal case was sent to the Sheki Serious Crimes Court for consideration, by a verdict dated April 9, 2021, Polad Ismayilov was found guilty under this article, and he was sentenced to 11 years in prison. By the decision of the Sheki Court of Appeal dated February 10, 2022, the defense appeal was not satisfied and the verdict was upheld.

By the decision of the Supreme Court on April 25, the defense’s cassation appeal was partially satisfied. The criminal case was reviewed in the court of appeal; by the verdict of the Sheki Court of Appeal dated December 28, P. Ismayilov was acquitted on the grounds that his guilt had not been proven.

After the corresponding verdict is received by the prosecutor’s office, a re-analysis and assessment of all evidence in the criminal case will be provided, and an objective decision will be made on whether to file a cassation protest.

During the period of further investigation, the Prosecutor General’s Office recommends that the media exercise caution when disseminating information related to such sensitive issues, as well as respect the rights of the injured party in a criminal case,” the supervisory agency said in a statement.

It is noted that P. Ismayilov was released after three years and ten months of imprisonment.
