Those who forged his wife’s signature on documents were acquitted

The Sheki Court of Appeal held a hearing on the appeal against the verdict against Ilgar Mustafayev, accused of forgery of documents and their use. According to oxu.az, at the trial chaired by Judge Aladdin Majidov, the complaint was satisfied.

Thus, the defendant was acquitted of the charges due to the lack of corpus delicti in his actions. The verdict of the court of first instance was overturned.

According to the indictment, I. Mustafayev forged a statement, which is considered an official document, with his wife’s signature. In addition, knowing that it was a fake, he deliberately submitted this document to the Yevlakh Territorial Department No. 17 of the State Real Estate Register Service under the State Committee of the Republic of Azerbaijan for Property Issues and received an extract for the apartment from the state real estate register in the name of his wife.

By the verdict of the Yevlakh District Court, Ilgar Mustafayev was found guilty under articles 320.1 (forgery or illegal production of a certificate or other official document granting rights or exempting from obligations for the purpose of its use or sale of such a document) and 320.2 (use of knowingly forged documents) of the Criminal Code of the Republic of Azerbaijan (UK AR).

However, due to the fact that the period provided for in Article 75.1.1 (exemption from criminal liability due to the expiration of the statute of limitations – two years after the commission of a crime that does not pose a great public danger) of the Criminal Code of the Azerbaijan Republic for bringing him to criminal liability has passed, he no punishment was given.
