In Azerbaijan, a number of powers of the Ministry of Justice regarding the organization of court cases are transferred to the Judicial-Legal Council
Many powers exercised by the Ministry of Justice in the field of organizing the work of courts are entrusted to the Judicial-Legal Council (JLC). According to oxu.az, this is reflected in the amendment proposed to the law “On Courts and Judges,” which was discussed at today’s meeting of the Milli Majlis and was recommended for consideration by parliament.
Thus, in accordance with the draft, the SPS is vested with powers regarding maintaining judicial statistics, organizing office work in courts, ensuring the labor and social rights of judges, taking measures to implement and observe labor discipline in the courts, checking the state of organization of work in these areas in the courts of the first and appellate instances, in case of vacancies in the positions of chairman and deputy chairman in the courts of first instance, temporarily assigning the performance of their duties to one of the judges, sending judges of the courts of first instance with their consent to another court, granting them vacations, approving the structure and staffing of the apparatus of these courts.
In accordance with other changes, the law excludes the possibility of an application from the relevant executive authority to initiate disciplinary proceedings against judges and to refer them to this body.
The period of assignment of judges with their consent to the SPS Office is reduced to one year.
In addition, the draft provides for the right of the Union of Rightist Forces to initiate disciplinary proceedings against judges of courts of all instances in cases established by law without any appeal.
It is proposed that the changes come into force on June 1, 2024.
After discussions, the amendment was put to a vote and adopted in the third reading.
