Have a court and prosecutor’s office swallowed insults?

According to publika.az, on 5th March, 2014 Yasamal court of Baku examining criminal case on accusation of Asif Aliyev, a victim Ilham Mirzeyev had charged a judge, prosecutor and Prosecutor General of Azerbaijan in protection, getting a bribe for artificial delaying of a process and making a decision in favour of Aliyev.

Instead of decision making that provided by a law, a judge and prosecutor had begun to calm I. Mirzeyev and ask him to stop insults.

On the next session, seeing helplessness of a court and prosecutor in implementing of justice, a defense part challenged them, but judge remained it without consideration.

According to defense statements, the insults of participants of a process are crime provided by the article 289 of Criminal procedural Code of Azerbaijan.

According to article 209.2.14 of Criminal procedural Code of Azerbaijan a criminal case initiates immediately upon a court’s insult.

The defense party expresses founded fear that blackmail and insults of court and the prosecutor can affect on the objectivity of the case decision.
